Are these the actual USCIS fees?
Yes — they reflect the current USCIS fee schedule (Form G-1055, Edition 02/17/2026), verified 2026-08-11. Most forms are cheaper to file online. The I-765 drops to $260 when filed together with a pending I-485 filed on or after April 1, 2024. Fees change; always confirm the current amount on uscis.gov/forms before filing.
What is the Asylum Program Fee?
Employers that file Form I-129, I-129CW, or I-140 also owe a separate Asylum Program Fee of $600 (or $300 for small employers with 25 or fewer full-time-equivalent employees; nonprofits are exempt). It is paid in addition to the base filing fee and is not included in the totals above.
What about premium processing?
Premium processing buys a faster adjudication window via Form I-907 — $2,965 for most I-129 and I-140 petitions, $1,780 for H-2B/R-1 and for I-765 OPT/STEM, and $2,075 for I-539 (new fees effective March 1, 2026). It is optional and not included in these base totals.
Do these include attorney fees?
No. These are government filing fees only. Legal representation, translation, medical-exam costs, and the Department of State immigrant visa fee (for consular cases) are separate and vary widely.
What about the new H.R.1 fees?
The One Big Beautiful Bill Act (H.R.1, effective Jan 1, 2026) added statutory fees for asylum-related and certain employment-authorization filings (for example, a $100 asylum filing fee and EAD add-ons of $560/$280).
